Terms & Conditions

Please read these Terms & Conditions carefully before placing an order or using the Stolen Cookies website. By accessing our website or placing an order, you agree to be bound by these terms. If you do not agree, please do not use our website or services.

1. About Us

Stolen Cookies operates the website www.stolencookies.co.nz and sells handmade baked goods to customers throughout New Zealand. References to "we", "us", or "our" in these terms refer to Stolen Cookies.

2. Placing an Order

By placing an order through our website, you are making an offer to purchase the products in your cart. All orders are subject to acceptance and availability.

We will confirm your order by email once it has been received. This confirmation does not constitute acceptance of your order — acceptance occurs when your order is dispatched.

We reserve the right to cancel or refuse any order at our discretion, for example if a product is unavailable or if there has been a pricing error. If this occurs, we will notify you promptly and arrange a full refund if payment has already been taken.

3. Pricing & Payment

All prices are listed in New Zealand dollars (NZD) and are inclusive of GST where applicable.

We reserve the right to update our prices at any time. The price you pay is the price displayed at the time you complete your order.

Payment is required in full at the time of placing your order. We use secure third-party payment processors and do not store your card details.

4. Production & Dispatch

Stolen Cookies are handmade in small batches once per week. All orders placed during the week are baked fresh and collected by our courier partner on Monday morning.

This means:

  • Orders placed after our weekly cut-off will be dispatched the following Monday.

  • We aim to deliver within 1 business day of dispatch, though delivery may take 1–2 additional days depending on your location and courier availability.

  • We do not guarantee delivery on a specific date for standard orders.

 

If you require faster delivery, same-day or express shipping options may be available at checkout for an additional cost. Express orders are subject to availability and cut-off times.

5. Shipping

We currently ship to New Zealand addresses only.

Shipping costs will be calculated and displayed at checkout before you complete your order.

Once your order has been dispatched, ownership and risk of the goods passes to you. We are not responsible for loss or damage caused by the courier after dispatch. If your order is lost or damaged in transit, please contact us and we will do our best to assist.

6. Food Products & Allergens

Our products are handmade food items. While we take care in our production process, our kitchen may handle common allergens including but not limited to: gluten, dairy, eggs, nuts, and soy.

It is your responsibility to check product descriptions and ingredient information before ordering. If you have any food allergies or intolerances, please contact us before placing an order so we can advise you appropriately.

We cannot guarantee that our products are free from any allergen due to the nature of our shared production environment.

7. Exchanges

As our products are handmade food items, we do not accept returns or offer refunds for change of mind.

We will offer an exchange if you receive the wrong item or if your order arrives damaged or faulty. Exchange requests must be made within 7 days of receiving your order and must include a photo of the issue. Please refer to our full Exchange Policy for details.

8. Intellectual Property

All content on the Stolen Cookies website — including text, images, photography, branding, logos, and product descriptions — is owned by or licensed to Stolen Cookies and is protected by New Zealand and international intellectual property laws.

You may not reproduce, distribute, or use any content from our website without our prior written permission.

9. Newsletter

By subscribing to our newsletter, you consent to receiving emails from Stolen Cookies about new product launches and promotions. We will not spam you or share your details with third parties.

You can unsubscribe at any time by clicking the unsubscribe link in any of our emails or by contacting us directly. Please refer to our Privacy Policy for full details on how we handle your data.

10. Limitation of Liability

To the fullest extent permitted by New Zealand law, Stolen Cookies will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of our website or products.

Our total liability to you in connection with any order will not exceed the amount paid by you for that order.

11. Your Rights Under New Zealand Law

Nothing in these Terms & Conditions limits or excludes any rights you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are a consumer, you have statutory rights that cannot be excluded by contract.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated date. Your continued use of our website after changes are posted constitutes your acceptance of the updated terms.

13. Governing Law

These Terms & Conditions are governed by the laws of New Zealand. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the New Zealand courts.
